After refusing to appear in court, Nintendo asked for a default judgment against streamer Jesse Keighin. Keighin leaked a series of unreleased Switch games using emulators. Nintendo lawsuits are often aggressive, but the company has lowered its requested damages.

Nintendo might be showing leniency to avoid negative publicity. With the switch 2 launch coming they don't want "Nintendo ruined another pirate's life" to be on people's minds. Now if they forgave Bowser's debts too (or suspended debt on the condition that he keeps his nose clean) I might consider buying another switch game.

YouTube recently taught me that if enough of us take on these giants in court, and keep beating the dead horse, they will run out of money.  Even if you lose, you just gotta file for bankruptcy and it's all wiped clean. Seriously, I'm sure we can find some internet freedom guys to help out.

I doubt he streamed emulation for the Switch 2 as your article states, which isn't released yet. Might want to correct that.
