The Osage bought their land it wasn't given to them.If I came and drilled a oil well in your front yard. And even though you owned the front yard I said you didn't have any say so in the project.You would take me to court and that's what the Osage did

This story propped up in several publications. But it was not clear what did they mine. Everyone mentioned mining as this was what the lawsuit was based on. But the closest argument I could gleam was that they had to dig into the land to build foundation for the wind turbines and that meant they were "mining".

Did they remove excavated materials from the site? Digging a hole for a foundation is not mining..

Unlike most tribes in Oklahoma the Osage actually purchased their land and the mineral rights to that land.


That's not to say however that the Chickasaw, Choctaw, Muskogee and other tribes that had to walk to Oklahoma had it easy.

Entel was asked to get a lease 10years ago and continued to ask them,they ignored the Osages and continued to do what they wanted using their land to mine rocks and build foundations under surface for wind turbines going against the US government dept of interior and sovereign rights of Osage Nation, following rules getting lease from tribe would have been simple,ignored request to lease.

No one, no company or individual has the right to do what this company did.  If they were mining, all profits from the mining should also be paid to the land owners.

When I had first heard the story after the ruling, alot of the reason was the courts ruled the mineral right extend vertical..to my understandingthe biggest issue was because tribe was not being paid mineral rights.

It says in the article, they got permission for using the surface (to build a wind farm), but not below ground. They used the windfarm as a pretext to use the land for mining which they didn't have permission to do. So they are being evicted off the land.
