Netflix is the one that has a contract to uphold. Whether and how the EU would compensate them is between them.
This can be solved at network level. For one, as network gets saturated, you simply won't have enough bandwidth to support the highest resolutions/ qualities. You either reduce the resolution/ quality, or you'll have to pause periodically and let the buffer fill. And then networks do have mechanisms to prioritize or cap certain traffic. Depending on contracts (what guarantees they actually make) and current state of affairs (state of emergency changes the game), ISPs could clamp down on video streaming, reducing available bandwidth.
